Asset Forfeiture
In 2015, the Legislature passed HB 233, which was signed by the Governor on May 6, 2015. The Bill, known as the Uniform Civil Forfeiture Procedure Act, is intended in part to promote greater transparency as to the use and distribution of forfeited assets. O.C.G.A. § 9-16-19 requires the Prosecuting Attorneys’ Council of Georgia to create standardized forms for reporting the distribution and use of such assets. Separate rules govern the reporting requirements of law enforcement agencies and district attorneys. The reporting forms must be submitted by January 31 for the previous calendar year.
